Partner Program Terms and Conditions
By registering as a partner in the PropMarketCap Partner Program (hereinafter referred to as the "Program"), you confirm your agreement with these Terms and Conditions (hereinafter referred to as the "Terms"). If you do not agree with the Terms in whole or in part, registration and participation in the Program are not permitted.
The Company reserves the right to make changes and additions to these Terms without prior notice. Continued participation in the Program after changes are made constitutes your agreement to such changes.
Violation of these Terms may result in suspension or termination of participation in the Program, as well as cancellation of accrued but unpaid commission fees.
1. Registration and Account
To register, you must provide accurate information, including your full name (or legal entity name), a valid email address, and any other requested details. Participation is only permitted for individuals who are 18 years of age or older.
One account may be used exclusively by one individual or legal entity. Sharing access credentials with third parties is prohibited.
The Company reserves the right to approve or reject any application at its discretion without explanation.
2. Affiliate Links and Promotion
Upon registration, the partner is provided with a unique referral link. Commission fees are accrued exclusively when a client follows a correctly formed affiliate link.
Partners may promote through online and offline channels, provided they comply with applicable law and these Terms.
Use of branded materials is permitted only in unmodified form. The Company reserves the right to modify marketing materials without notice. Mass mailings using the Company's name without written consent are prohibited.
3. Commission Fees and Payments
Commission fees are accrued for confirmed purchases made by clients via an affiliate link and/or promo code. The commission structure may be changed at the Company's discretion.
Commissions are not accrued for canceled, refunded, or disputed transactions, or in cases where fraud is detected.
The Company reserves the right to conduct reviews and temporarily withhold accruals as part of compliance and anti-fraud procedures.
The minimum payout amount is 100 (one hundred) US dollars. The partner is solely responsible for paying applicable taxes and fees.
4. Clients
Referred clients are considered clients of the Company and are served in accordance with the Company's current rules, rates, and policies.
5. Cookies
Tracking is carried out via cookies. If cookies are blocked or deleted, correct commission accrual cannot be guaranteed.
6. Termination of Participation
The partner may terminate participation in the Program by notifying the Company via email. The Company reserves the right to terminate a partner's participation at any time at its discretion.
7. Intellectual Property
The partner agrees to comply with copyright and trademark laws. Unauthorized use of third-party materials is prohibited.
8. Prohibited Activities
Partners are prohibited from:
- Placing misleading advertising or false promises about the platform and/or program
- Using spam or unsolicited commercial advertising
- Taking actions that damage the Company's reputation
- Violating applicable law when promoting
9. Limitation of Liability
The Company is not liable for indirect losses, lost profits, data loss, or other financial losses arising in connection with participation in the Program, except as expressly provided by applicable law.
10. Independence of Parties
The parties are independent contractors. These Terms do not create a partnership, agency, franchise, or employment relationship.
11. Force Majeure
The Company is released from liability for failure to fulfill obligations due to force majeure circumstances, including natural disasters, military actions, government decisions, and other events beyond reasonable control.
12. Dispute Resolution
Disputes shall be resolved through arbitration in accordance with applicable law.
13. Final Provisions
These Terms constitute the entire agreement between the parties and supersede all prior arrangements.
